The case presented several challenges, including the need for sensitive discussions with Mrs. P.’s parents, who were grappling with both the emotional and physical demands of caring for a severely brain-injured family member. Given the extent of Mrs. P.’s injuries, which included paraplegia, securing a comprehensive settlement to provide for round-the-clock care and long-term rehabilitation was paramount.

While breach of duty was conceded by the defendant, the primary legal focus was on causation, specifically under the principles established in Bailey v MOD. Expert neurology evidence supported this argument, reinforcing the claim that the ambulance service’s failings materially contributed to the severity of Mrs. P.’s condition.

Particulars of Claim (POCs) were prepared and served on the defendant’s solicitors on a without prejudice basis. If no substantive response was received by the agreed deadline, Kate was prepared to issue proceedings in the High Court and seek a split trial on liability.
